The Supreme Court of Nigeria has confirmed that the Speaker of Delta State House of Assembly, Oborevwori Sheriff Francis Orohwedor, will represent PDP in the 2023 governorship election in Delta State.
The Apex Court upheld the decision of the Court of Appeal, which voided and set aside the judgment of the Federal High Court. The decision still stands after having been upheld again.
The court ruled that the Speaker of the House couldn’t be found guilty beyond a reasonable doubt of supplying false information or forgery.
The Court agreed that the appellant should have filed a complaint in the Federal High Court, where courts make resolutions happen through Summons. This requires the use of affidavits and not requests made by Summons.
Justice Abubakar ruled in favour of Oborevwori Sheriff Francis Orohwed, as set forth by his attorney Mr Damian Dodo (SAN).
The Supreme Court unanimously agreed that the appellant, David Edevbie had no merit to his arguments and elected to dismiss the case.
