The Court of Appeal in Abuja has rejected the March 8 decision by Justice Inyang Ekwo to remove Ebonyi Governor David Umahi and his deputy for switching from the People’s Democratic Party (PDP) to the All Progressives Congress (APC).
In Friday’s judgment, three members of the appellate court said that there is no punishment for a person who defects from their party. This person can become Governor or Deputy Governor without consequences.
The Court of Appeals ruled that, if a Governor or Deputy Governor leaves their party, the only option available is to explore the impeachment option available in the Constitution.
The Court of Appeal in Abuja agreed with an earlier decision stemming from the court’s Enugu division.
